Please read these Terms of Service ("Terms") carefully before using the Big Lead Scraper application ("the Software") and the bigleadscraper.com website ("the Website"), operated by BigMarketer ("us", "we", or "our").

  • Data protection regulations applicable in your jurisdiction

You shall not use the Software or any data extracted through it for purposes of harassment, stalking, sending unsolicited commercial messages (spam), or any other activity that is illegal or harmful.

The Software, the Website, and all associated content, features, and functionality (including but not limited to design, text, graphics, logos, icons, images, audio clips, software code, and the compilation thereof) are the exclusive property of BigMarketer and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The "Big Lead Scraper" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of BigMarketer. You must not use such marks without our prior written permission.

6. Disclaimers

The Software and the Website are provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied. We do not warrant that:

  • The Software will function uninterrupted, securely, or error-free

  • The Software will be compatible with future changes made by search engines or target websites
  • Any defects in the Software will be corrected

BigMarketer expressly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall BigMarketer, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Software or the Website
  • Any conduct or content of any third party
  • Any content obtained from the Software or the Website
  • Unauthorized access, use, or alteration of your data

8. Indemnification

You agree to defend, indemnify, and hold harmless BigMarketer and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Software or the Website, your violation of these Terms, or your violation of any third-party rights.

9. Termination

We may terminate or suspend your access to the Software and the Website immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Software will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BigMarketer operates, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through good faith negotiation, and if necessary, through binding arbitration or the appropriate courts of law.

11. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

12. Entire Agreement

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and BigMarketer regarding the use of the Software and the Website, and supersede all prior agreements, understandings, and negotiations, whether written or oral.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Software or Website after those revisions become effective, you agree to be bound by the revised terms.
